Terms & Conditions

These Terms & Conditions apply to www.spark-text.com and sparktext.app, operated by SparkText, a Netherlands-based sole proprietorship (eenmanszaak).

1. Acceptance of these Terms

These Terms & Conditions (“Terms”) form a legally binding agreement between you and SparkText (“SparkText”, “we”, “us”, “our”), the operator of the SparkText service and any associated interfaces (together, the “Service”).

You accept these Terms by doing any of the following:

• Creating a SparkText account
• Accessing or browsing any part of the Service
• Subscribing to a paid plan
• Using any feature of the Service

If you use SparkText on behalf of a company or organisation, you confirm you have authority to bind that entity, and “you” refers to that entity.

If you do not agree to these Terms, do not use SparkText.

2. Eligibility

SparkText is for adults only. To use the Service you must:

• Be at least 18 years old
• Meet the age of legal majority in your jurisdiction, where that is higher than 18
• Have the legal capacity to enter a binding agreement
• Not be barred from using the Service under any applicable law

By using SparkText you represent and warrant that you meet all of these requirements. The Service is not intended for and must not be used by anyone under 18. If we become aware that a user is under 18, we will terminate the account without notice.

SparkText is designed for personal, non-commercial use in adult dating and social communication contexts.

3. Your account

3.1 Registration

You may register with an email address and password, or through a supported third-party sign-in provider such as Google. You agree to provide accurate, complete information and to keep it current.

3.2 Account security

You are responsible for:

• Keeping your password and login credentials confidential
• All activity under your account, whether or not you authorised it
• Telling us promptly at support@spark-text.com if you suspect unauthorised use

We are not liable for loss or damage arising from your failure to protect your credentials. If you sign in through a third-party provider, that provider’s own security and terms also apply.

3.3 One account per person

You may not create multiple accounts to get around usage limits, access paid features without paying, or evade a suspension. We may merge or remove duplicate accounts.

4. What the Service is

4.1 What SparkText does

SparkText is an AI-powered communication assistant and coaching tool for dating and social messaging. Features include:

• Reply suggestions. You paste a conversation or upload screenshots and receive suggested responses in different tones, which vary by plan.
• Reply tweaks. You can adjust a suggestion to be shorter, funnier, more direct or less intense.
• Next-move coaching. Coach analyses the conversation and suggests what to do next, including timing, positioning and risk flags. Sometimes that advice is to send nothing.
• Conversation stages. You set the stage of a conversation and Coach applies different rules to each. Some stages are limited to paid plans.
• Screenshot upload and text extraction. You upload screenshots, we extract the text into a transcript. Extraction is not perfect and you are responsible for reviewing and correcting it.
• Match Memory. You create matches and attach facts, preferences, wins and setup details, which personalise future suggestions.
• Match Insights. Interpretive analytics for a match, such as vibe, momentum, effort balance, responsiveness and risk flags. Some of these are measured from your conversation data and some are AI interpretations. Section 5 explains the difference.
• Advanced Spark Openers. On Pro, opener suggestions drawn from a curated library and matched to stage and context, subject to daily limits.
• Voice matching. On Pro, SparkText stores short excerpts of your own writing and derives a description of your writing style so suggestions sound more like you. Section 10.2 and our Privacy Policy explain this in full.
• Premium Controls. On Pro, global tone and escalation settings that shape every suggestion.
• Date Debrief. After a date, you tell Coach how it went and receive follow-up guidance.
• Profile Score. You upload screenshots of your own dating profile and receive a score with suggested improvements.
• Analyse their profile. You upload screenshots of a match’s public dating profile and receive a read of it plus suggested opening angles. Section 8 applies to these uploads in full.
• Language detection. SparkText detects the language of a conversation and tells you when it is not English. See section 4.3.

4.2 What SparkText is not

SparkText is a drafting and analysis tool. It is not, and must not be treated as:

• A guarantee of dating success, romantic outcomes or replies
• A dating platform, matchmaking service or social network
• Therapy, mental health care or counselling
• Legal, financial or medical advice
• A surveillance, tracking or lie-detection tool
• A tool that acts on your behalf on any other platform

4.3 English-first

SparkText is built and tuned for English conversations. It detects the language of a conversation and will warn you when it is not English, but coaching quality for other languages is materially lower and Advanced Spark Openers are English only. Using SparkText for non-English conversations is at your own discretion.

4.4 The 60-day context window

4.5 The Service will change

We are actively developing SparkText. Features may be added, changed, restricted or withdrawn. We will give reasonable notice of significant changes that affect paid features, but we are not obliged to keep any particular feature indefinitely.

5. AI limitations and no guarantees

SparkText uses AI models to produce reply suggestions, coaching advice and analysis. You must understand the following:

• Output may be wrong or inappropriate. AI-generated content can be inaccurate, incomplete, misleading, contextually off or unsuited to your specific situation.
• Tone analysis is probabilistic. Any assessment of another person’s tone, intent, interest or mood is an inference, not a fact. The other person may feel entirely differently.
• Extraction may be imperfect. Text taken from screenshots may contain errors, misidentified speakers or missing context. Always review it before acting on it.
• Coach only knows what you tell it. It cannot see the full picture of any relationship, conversation or person, and it cannot see anything older than the 60-day window in section 4.4.
• No guaranteed outcomes. SparkText cannot guarantee that following its suggestions produces a reply, a date, a relationship or any other result.
• Voice matching shapes style, not accuracy. A suggestion that sounds like you is not for that reason a better or safer thing to send.

5.1 Measured signals versus AI interpretation

Some figures in Match Insights are calculated directly from your conversation data rather than inferred by a model. Responsiveness and effort balance, for example, are computed from message timestamps and message counts. Where a figure is measured we label it as such in the app.

Everything else, including momentum readings, vibe descriptions, risk flags, date readiness and compatibility signals, is an analytical heuristic, not a measurement of reality. Do not treat any of it as an objective statement about another person.

Apply your own judgement before using any SparkText output. We help you think and draft. We are not a substitute for your own discretion.

6. Your responsibility for communications

SparkText does not send any message on your behalf. Every message you send using a SparkText suggestion is sent by you, from your own account, on your own platform.

You agree that:

• You are solely responsible for every message, action and communication you make using SparkText guidance.
• You will read AI-generated suggestions before sending them. Do not send content you have not read.
• You will not use SparkText to send messages that are harmful, deceptive, harassing, illegal or likely to cause distress.
• You will not rely on SparkText to navigate sensitive, high-stakes, emotionally complex or legally significant communications without applying substantial personal judgement.
• You will not use SparkText to craft communications designed to manipulate, exploit or deceive another person.

7. Acceptable use

You may use SparkText only for lawful purposes and consistently with these Terms. The following is strictly prohibited.

7.1 Harm to others

• Harassing, threatening, intimidating, bullying, stalking or harming any person.
• Generating or sending content that is sexually exploitative, coercive or non-consensual.
• Targeting or contacting minors through any channel, including with content generated by SparkText.
• Facilitating domestic abuse, coercive control, or the manipulation of vulnerable individuals.

7.2 Deception and fraud

• Catfishing: impersonating someone else or maintaining a false identity.
• Fraud, blackmail, or extracting money, favours or data from another person by deception.
• Materially deceiving another person about your identity, intentions or circumstances.
• Impersonating a real person, business or public figure.

7.3 Illegal and harmful activity

• Using SparkText in connection with any illegal conduct.
• Uploading illegal material, including child sexual abuse material.
• Hate speech or discrimination based on race, gender, sexual orientation, religion, disability or any other protected characteristic.
• Facilitating human trafficking, exploitation or modern slavery.

7.4 Platform integrity

• Reverse engineering, decompiling, disassembling or extracting source code or model weights.
• Scraping, crawling or data-mining the Service with automated tools.
• Bypassing or disabling plan limits, usage caps, cooldowns, content filters or access controls.
• Creating accounts or using technical workarounds to reach features above your plan without paying.
• Uploading malware, harmful scripts or code designed to interfere with the Service.

7.5 Third-party rights

• Uploading screenshots, messages or content you do not have the right to share or process.
• Violating another person’s privacy, confidentiality or data rights through your use of SparkText.
• Using SparkText in a way that breaches another platform’s terms in a manner creating risk or harm.
• Uploading content that infringes anyone’s intellectual property.

7.6 Spam and commercial misuse

• Generating bulk or mass messages for spam purposes.
• Using SparkText output for commercial marketing, advertising or lead generation without our written permission.

We decide, at our discretion, whether conduct breaches these rules. A breach may result in immediate suspension or termination without notice or refund.

8. Screenshots, transcripts and uploaded content

8.1 Your right to upload

When you upload screenshots, paste a transcript or provide any other content, you represent and warrant that:

• You have the legal right to upload, share and process that content.
• Doing so breaks no applicable law, including privacy law, and no confidentiality obligation or third-party platform term.
• You are not uploading content belonging to a minor.
• The content is not illegal and is not something you lack the right to share.

8.2 The privacy of other people

SparkText is a personal coaching tool. When you upload conversations with another person, or screenshots of their dating profile, that person has not agreed to share their messages or profile with us. You are responsible for ensuring your use complies with:

• Data protection and privacy law in your jurisdiction, including the GDPR where it applies
• Any confidentiality expectations in your communications with others
• The terms of the platform where those conversations or profiles originally appeared

This applies in full to the Analyse their profile feature, where the content you upload is entirely about another person.

8.3 How we process and store uploaded content

Uploaded screenshots and pasted transcripts are processed by our AI provider to extract text, infer context and generate output. Specifically:

• Raw screenshot files are never stored. Your upload is converted in memory, sent for text extraction, and discarded. The image never reaches our database.
• Extracted and pasted text is stored in your account for up to 60 days. Coach uses it as context across a conversation, to track momentum and to build Match Insights. It is not only returned to your browser.
• Coaching output is stored for up to 60 days: the suggestions Coach generates, your edits of them, and its analyses of a conversation.
• On Pro, short excerpts of your own messages are stored to build your voice profile, subject to the same 60-day window. You can view and delete these, and switch the feature off.
• Everything above is deleted automatically 60 days after it is created, by a job that runs daily.
• Match Memory items you deliberately save are stored until you delete them.

Our Privacy Policy sets out the full detail, including legal bases and your rights.

9. Privacy and personal data

Your use of SparkText is also governed by our Privacy Policy, which explains what we collect, how we use it, who we share it with and your rights. By using the Service you agree to the processing described there.

In summary, SparkText may process:

• Account information (email, authentication data, profile settings)
• Conversation content, screenshots and transcripts you provide
• Match Memory items you explicitly save
• Coaching preferences, goals and setup information
• On Pro, short excerpts of your own writing used for voice matching
• Usage data, feature interactions and plan activity

If these Terms and the Privacy Policy appear to conflict on a question of data handling, the Privacy Policy governs.

10. User content and licence

10.1 Ownership

You keep ownership of the content you upload, paste or provide (“User Content”), including screenshots, messages and saved notes.

10.2 The licence you give us

By submitting User Content you grant SparkText a non-exclusive, worldwide, royalty-free, sublicensable licence to use, store, process, reproduce, analyse, transmit and display that content to the extent necessary to:

• Provide and operate the Service
• Generate AI output in response to your requests
• Store content you have chosen to save, such as Match Memory items
• On Pro, derive and maintain a description of your writing style from excerpts of your own messages, for the sole purpose of styling the suggestions we write for you
• Maintain, secure and improve the Service
• Meet our legal obligations

This licence exists only to operate the Service. We do not claim ownership of your personal communications, and we do not use your conversations to train AI models. The licence ends when you delete the relevant content or close your account, subject to any legally required retention period.

10.3 Content standards

You are responsible for ensuring your User Content complies with these Terms. We may remove User Content that breaches these Terms or applicable law, without notice.

11. AI-generated output

• Personal use. Output is provided for your personal use in the communications SparkText is designed to support.
• Not unique. Similar inputs from different users may produce similar or identical output. We do not guarantee your output is exclusive to you. Advanced Spark Openers in particular are drawn from a shared, curated library.
• No warranty. We do not warrant that output is accurate, appropriate, effective or suitable. See sections 5 and 17.
• Our intellectual property. The systems, models, prompts, interfaces and processes that generate output belong to us or our licensors. Giving you output transfers no ownership of any of that.
• Your responsibility. Any output you actually send becomes your own communication, and you are responsible for it.

12. Subscriptions, billing and withdrawal

12.1 Plans

SparkText offers a Free plan and paid plans (Plus and Pro). Current features, prices and usage limits for each plan are set out on our Pricing page and in the app. Plan details may change and we will give reasonable notice of material changes to existing subscribers.

12.2 Automatic renewal

Paid subscriptions renew automatically at the end of each billing period, monthly or annual depending on your choice, at the then-current price, unless you cancel before the renewal date. By subscribing you authorise us, through our payment processor Stripe, to charge your payment method on a recurring basis.

12.3 Billing and payment

• Payments are processed by Stripe. By providing payment details you also accept Stripe’s terms.
• Prices are shown at checkout and may be presented in USD or GBP depending on your location.
• Applicable taxes such as VAT may be added at checkout depending on your jurisdiction.
• Your billing date is set when you first subscribe and may shift if you change plan mid-cycle.

12.4 Plan changes

• Upgrades take effect immediately. You are charged a prorated amount for the remainder of the current period.
• Downgrades take effect at the end of the current period. You keep higher-tier features until then.
• Cancellation is available at any time in your account settings or by contacting us. Cancelling stops future renewals; you keep access until the end of the period you have paid for.

12.5 Refunds

Subscription fees are non-refundable except:

• Where required by consumer protection law in your jurisdiction, including the withdrawal right in section 12.8
• Where we expressly state a refund policy for a specific promotion or offer

If you think a billing error has occurred, contact us within 30 days of the charge at support@spark-text.com.

12.6 Failed payments

If a payment fails we may retry it. If payment is not received we may downgrade your account to Free or suspend access until it is resolved. We will try to notify you.

12.7 Price changes

We may change prices. We will give at least 30 days’ notice of a price change to active subscribers, by email or in-app notice. If you do not accept the new price you may cancel before it takes effect.

12.8 Right of withdrawal (EU and UK consumers)

13. Usage limits and Sparks

SparkText uses a “Spark” system to measure usage. A Spark is one use of the coaching engine.

The following also applies:

• Free and Plus plans have a rolling 24-hour Spark allowance. Once it is used up, actions that cost a Spark are unavailable until the window resets.
• Pro has an unlimited Spark allowance, subject to the fair-use rules below.
• Separate from Sparks, some features carry their own limits. On the Free plan, screenshot extraction is limited to a set number of extractions per day, and some conversation stages and Insights are reserved for paid plans. Advanced Spark Openers are limited per match per day on Pro. Current limits are listed on the Pricing page.
• Unused Sparks do not roll over or accumulate beyond the rolling window.
• We may impose rate limits, cooldowns or throttling on any plan to protect the Service from abuse or excessive load.
• If we detect usage inconsistent with normal personal use, such as automated requests, scraping or commercial use at scale, we may restrict, throttle or terminate access without notice.

We may adjust feature access and limits as the product develops, with reasonable notice where practical.

14. Intellectual property

14.1 Our ownership

SparkText and everything that makes it up, including software, code, design, interface, branding, trade marks, logos, AI prompting systems, the Advanced Spark Openers library, content and documentation, is owned by or licensed to us and protected by copyright, trade mark and other intellectual property law.

14.2 What you may not do

Unless we give written permission or the law allows it, you must not:

• Copy, reproduce, distribute or publicly display any part of the Service.
• Reverse engineer, decompile, disassemble or try to extract source code or model weights.
• Modify, adapt or create derivative works from the Service or its output for commercial purposes.
• Remove, alter or obscure any proprietary notices.
• Resell, license or sublicense access to the Service.
• Frame or mirror the Service on another website without our permission.

14.3 Feedback

If you send us feedback, ideas or suggestions, you grant us the right to use them freely, with no obligation to compensate or credit you.

15. Beta and experimental features

We may offer features labelled beta, experimental, early access or preview. These are provided as-is with no warranty of any kind. They may:

• Be incomplete, unstable or behave unexpectedly
• Change significantly or be removed at any time without notice
• Not be available to all users or on all plans
• Produce less reliable output than established features

Use of any beta feature is at your own risk, and we are not liable for loss arising from your reliance on one.

16. Third-party services and platforms

16.1 Infrastructure providers

SparkText depends on third parties to operate, including AI model providers, cloud hosting and database providers, payment processors, authentication providers and analytics tools. We choose these carefully, but we are not responsible for an outage, error, data loss or failure originating in a third party’s own systems.

16.2 Dating apps and messaging platforms

SparkText helps you draft messages for use on third-party platforms such as Tinder, Bumble, Hinge, Instagram and WhatsApp. SparkText is not affiliated with, endorsed by or connected to any of them. Your use of SparkText in connection with those platforms must comply with their own terms, and we are not responsible for any consequence arising from your use of them.

16.3 Third-party links

The Service may link to external sites. We do not control them and are not responsible for their content, accuracy or practices. Visiting them is at your own risk.

17. Disclaimers

To the fullest extent the law permits, we disclaim all warranties, including:

• Implied warranties of merchantability, fitness for a particular purpose, title and non-infringement.
• Any warranty that the Service will be uninterrupted, error-free, secure or free of viruses.
• Any warranty that output will be accurate, complete, reliable, contextually appropriate or fit for a specific purpose.
• Any warranty that using SparkText will result in a date, a reply, a relationship or any romantic or social outcome.
• Any warranty that SparkText will correctly detect emotional nuance, intent, risk or compatibility.
• Any warranty that the Service will be available at a particular time or place.

Nothing here limits rights you have under consumer protection law that cannot be excluded by contract.

18. Limitation of liability

To the fullest extent the law permits:

18.1 Exclusion of consequential damages

SparkText and its directors, employees, contractors, affiliates, suppliers and licensors will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, however caused, including:

• Loss of profits or revenue
• Loss of data or business opportunity
• Emotional distress, embarrassment or reputational harm
• Relationship damage, failed romantic outcomes or dating consequences
• Harm caused by messages you sent using SparkText output
• Service outages or loss of access
• Problems originating with third-party providers

18.2 Cap on liability

Our total aggregate liability for all claims relating to the Service or these Terms will not exceed the greater of:

• The total amount you paid us in the 12 months before the event giving rise to the claim, or
• EUR 50 (fifty euros), if you have not paid us anything

18.3 What we never exclude

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under Dutch or other applicable law.

18.4 Consumer rights

Nothing in this section affects statutory rights you have as a consumer that cannot be limited or excluded under the law of your country of residence.

19. Indemnification

You agree to defend, indemnify and hold harmless SparkText and its directors, employees, contractors, affiliates, suppliers and licensors against claims, damages, losses, costs and expenses, including reasonable legal fees, arising from:

• Your use of the Service in breach of these Terms
• Content you upload, submit or generate
• Messages you send using SparkText guidance, and their consequences
• Any third-party claim arising from your conduct in connection with the Service
• Your breach of any law or of anyone’s rights

We may, at our own expense, take over the exclusive defence of any matter subject to indemnification by you, and you agree to cooperate. This section does not apply where you are a consumer and the law of your country does not permit it.

20. Suspension and termination

20.1 By us

We may suspend or terminate your access at any time, with or without notice, for reasons including:

• Breach of these Terms or our policies
• Conduct posing a legal, reputational or security risk to SparkText or its users
• Payment failure or fraud risk
• A request from law enforcement or a regulator
• Discontinuation of the Service in whole or in part

Where we suspend for a suspected breach we may investigate before deciding. We will give notice where we can do so without compromising security or an investigation.

20.2 By you

You may stop using SparkText at any time. To delete your account and the data associated with it, email support@spark-text.com from the address on your account. We will confirm and complete the deletion within 30 days.

You can already delete individual matches, Match Memory items and, on Pro, your stored voice data directly in the app. Deleting your account does not entitle you to a refund for an unexpired subscription period, except as required by law or under section 12.8.

20.3 Effect of termination

On termination:

• Access to paid features ends on the effective termination date
• We delete or anonymise your personal data in line with our Privacy Policy, except where we must keep records to meet a legal obligation, such as the seven-year retention of billing records required for Dutch and EU accounting
• Sections 6, 7, 9, 10, 11, 14, 17, 18, 19, 22 and 23 survive termination

21. Changes

21.1 Changes to the Service

We may update, modify, add or remove features at any time. We will try to give reasonable notice of significant changes, particularly to paid features, but we are not obliged to maintain any specific functionality.

21.2 Changes to these Terms

We may update these Terms. When we do we will:

• Update the “Last updated” date at the top of this page
• Notify you by email or in-app notice for material changes
• Give at least 14 days’ notice before material changes take effect

Continuing to use the Service after the effective date means you accept the updated Terms. If you do not agree, stop using the Service and cancel any paid subscription before the changes take effect.

22. Governing law and disputes

These Terms and any dispute arising from them or from the Service are governed by the law of the Netherlands, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods.

The courts of Amsterdam, the Netherlands have exclusive jurisdiction, except that:

• If you are a consumer resident in the EU or UK, you keep the protection of the mandatory consumer law of your country of residence, and you may bring proceedings in the courts of that country.
• We may bring proceedings in the courts of your country of residence where the law requires it.

22.1 Talk to us first

Before starting formal proceedings, please contact us at support@spark-text.com. Most problems are quicker to fix directly, and we would rather resolve it that way.

22.2 Online dispute resolution

EU consumers may also use the European Commission’s Online Dispute Resolution platform. We are not obliged to participate in proceedings before a consumer arbitration board and do not currently do so.

23. General provisions

• Entire agreement. These Terms, together with the Privacy Policy and any other referenced policies, form the entire agreement between you and SparkText regarding the Service. On questions of data handling, the Privacy Policy governs.
• Severability. If any provision is found invalid or unenforceable, the rest continues in full force.
• Waiver. Failing to enforce a right or provision is not a waiver of it.
• Assignment. You may not assign or transfer your rights or obligations without our written consent. We may assign ours to an affiliate, successor or acquirer without restriction.
• No partnership. Nothing in these Terms creates a partnership, joint venture, agency or franchise relationship between you and SparkText.
• Force majeure. We are not liable for delay or failure caused by events beyond our reasonable control, including internet outages, AI provider outages, government action or natural events.
• Language. These Terms are written in English. Any translation is for convenience only, and the English version prevails in case of conflict.

24. Contact
