These Terms & Conditions apply to www.spark-text.com and sparktext.app, operated by SparkText, a Netherlands-based sole proprietorship (eenmanszaak).
These Terms & Conditions (“Terms”) form a legally binding agreement between you and SparkText (“SparkText”, “we”, “us”, “our”), the operator of the SparkText service and any associated interfaces (together, the “Service”).
You accept these Terms by doing any of the following:
If you use SparkText on behalf of a company or organisation, you confirm you have authority to bind that entity, and “you” refers to that entity.
If you do not agree to these Terms, do not use SparkText.
SparkText is for adults only. To use the Service you must:
By using SparkText you represent and warrant that you meet all of these requirements. The Service is not intended for and must not be used by anyone under 18. If we become aware that a user is under 18, we will terminate the account without notice.
SparkText is designed for personal, non-commercial use in adult dating and social communication contexts.
You may register with an email address and password, or through a supported third-party sign-in provider such as Google. You agree to provide accurate, complete information and to keep it current.
You are responsible for:
We are not liable for loss or damage arising from your failure to protect your credentials. If you sign in through a third-party provider, that provider’s own security and terms also apply.
You may not create multiple accounts to get around usage limits, access paid features without paying, or evade a suspension. We may merge or remove duplicate accounts.
SparkText is an AI-powered communication assistant and coaching tool for dating and social messaging. Features include:
SparkText is a drafting and analysis tool. It is not, and must not be treated as:
SparkText is built and tuned for English conversations. It detects the language of a conversation and will warn you when it is not English, but coaching quality for other languages is materially lower and Advanced Spark Openers are English only. Using SparkText for non-English conversations is at your own discretion.
Conversation content and coaching output are retained for a maximum of 60 days and then deleted automatically by a scheduled job. This is a feature of the Service, not only a privacy measure: Coach genuinely cannot draw on anything older, because it no longer exists in our systems. Items you deliberately save to Match Memory are the exception and stay until you delete them.
We are actively developing SparkText. Features may be added, changed, restricted or withdrawn. We will give reasonable notice of significant changes that affect paid features, but we are not obliged to keep any particular feature indefinitely.
SparkText uses AI models to produce reply suggestions, coaching advice and analysis. You must understand the following:
Some figures in Match Insights are calculated directly from your conversation data rather than inferred by a model. Responsiveness and effort balance, for example, are computed from message timestamps and message counts. Where a figure is measured we label it as such in the app.
Everything else, including momentum readings, vibe descriptions, risk flags, date readiness and compatibility signals, is an analytical heuristic, not a measurement of reality. Do not treat any of it as an objective statement about another person.
Apply your own judgement before using any SparkText output. We help you think and draft. We are not a substitute for your own discretion.
SparkText does not send any message on your behalf. Every message you send using a SparkText suggestion is sent by you, from your own account, on your own platform.
You agree that:
SparkText accepts no responsibility for the real-world consequences of messages you send, however those messages were drafted or inspired.
You may use SparkText only for lawful purposes and consistently with these Terms. The following is strictly prohibited.
We decide, at our discretion, whether conduct breaches these rules. A breach may result in immediate suspension or termination without notice or refund.
When you upload screenshots, paste a transcript or provide any other content, you represent and warrant that:
SparkText is a personal coaching tool. When you upload conversations with another person, or screenshots of their dating profile, that person has not agreed to share their messages or profile with us. You are responsible for ensuring your use complies with:
This applies in full to the Analyse their profile feature, where the content you upload is entirely about another person.

Uploaded screenshots and pasted transcripts are processed by our AI provider to extract text, infer context and generate output. Specifically:
Our Privacy Policy sets out the full detail, including legal bases and your rights.
Your use of SparkText is also governed by our Privacy Policy, which explains what we collect, how we use it, who we share it with and your rights. By using the Service you agree to the processing described there.

If these Terms and the Privacy Policy appear to conflict on a question of data handling, the Privacy Policy governs.
You keep ownership of the content you upload, paste or provide (“User Content”), including screenshots, messages and saved notes.
By submitting User Content you grant SparkText a non-exclusive, worldwide, royalty-free, sublicensable licence to use, store, process, reproduce, analyse, transmit and display that content to the extent necessary to:
This licence exists only to operate the Service. We do not claim ownership of your personal communications, and we do not use your conversations to train AI models. The licence ends when you delete the relevant content or close your account, subject to any legally required retention period.
You are responsible for ensuring your User Content complies with these Terms. We may remove User Content that breaches these Terms or applicable law, without notice.
SparkText offers a Free plan and paid plans (Plus and Pro). Current features, prices and usage limits for each plan are set out on our Pricing page and in the app. Plan details may change and we will give reasonable notice of material changes to existing subscribers.
Paid subscriptions renew automatically at the end of each billing period, monthly or annual depending on your choice, at the then-current price, unless you cancel before the renewal date. By subscribing you authorise us, through our payment processor Stripe, to charge your payment method on a recurring basis.
Subscription fees are non-refundable except:
If you think a billing error has occurred, contact us within 30 days of the charge at support@spark-text.com.
If a payment fails we may retry it. If payment is not received we may downgrade your account to Free or suspend access until it is resolved. We will try to notify you.
We may change prices. We will give at least 30 days’ notice of a price change to active subscribers, by email or in-app notice. If you do not accept the new price you may cancel before it takes effect.
If you are a consumer in the EU or the UK, you normally have 14 days from the start of a subscription to withdraw from it and receive a refund, with no reason required.
Because SparkText is a digital service supplied immediately, you are asked at checkout to request immediate access and to acknowledge that doing so means you lose the withdrawal right once the service has been fully performed. Where you have made that request and started using paid features, we may reduce any refund proportionately to reflect what you have already used.
To withdraw, email support@spark-text.com within 14 days of your first payment. No particular form of words is needed. We will refund within 14 days of receiving your notice, using the same payment method.
SparkText uses a “Spark” system to measure usage. A Spark is one use of the coaching engine.

SparkText and everything that makes it up, including software, code, design, interface, branding, trade marks, logos, AI prompting systems, the Advanced Spark Openers library, content and documentation, is owned by or licensed to us and protected by copyright, trade mark and other intellectual property law.
Unless we give written permission or the law allows it, you must not:
If you send us feedback, ideas or suggestions, you grant us the right to use them freely, with no obligation to compensate or credit you.
We may offer features labelled beta, experimental, early access or preview. These are provided as-is with no warranty of any kind. They may:
Use of any beta feature is at your own risk, and we are not liable for loss arising from your reliance on one.
SparkText depends on third parties to operate, including AI model providers, cloud hosting and database providers, payment processors, authentication providers and analytics tools. We choose these carefully, but we are not responsible for an outage, error, data loss or failure originating in a third party’s own systems.
SparkText helps you draft messages for use on third-party platforms such as Tinder, Bumble, Hinge, Instagram and WhatsApp. SparkText is not affiliated with, endorsed by or connected to any of them. Your use of SparkText in connection with those platforms must comply with their own terms, and we are not responsible for any consequence arising from your use of them.
The Service may link to external sites. We do not control them and are not responsible for their content, accuracy or practices. Visiting them is at your own risk.
To the fullest extent the law permits, we disclaim all warranties, including:
Nothing here limits rights you have under consumer protection law that cannot be excluded by contract.

SparkText and its directors, employees, contractors, affiliates, suppliers and licensors will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, however caused, including:

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under Dutch or other applicable law.
Nothing in this section affects statutory rights you have as a consumer that cannot be limited or excluded under the law of your country of residence.
You agree to defend, indemnify and hold harmless SparkText and its directors, employees, contractors, affiliates, suppliers and licensors against claims, damages, losses, costs and expenses, including reasonable legal fees, arising from:
We may, at our own expense, take over the exclusive defence of any matter subject to indemnification by you, and you agree to cooperate. This section does not apply where you are a consumer and the law of your country does not permit it.
We may suspend or terminate your access at any time, with or without notice, for reasons including:
Where we suspend for a suspected breach we may investigate before deciding. We will give notice where we can do so without compromising security or an investigation.
You may stop using SparkText at any time. To delete your account and the data associated with it, email support@spark-text.com from the address on your account. We will confirm and complete the deletion within 30 days.
You can already delete individual matches, Match Memory items and, on Pro, your stored voice data directly in the app. Deleting your account does not entitle you to a refund for an unexpired subscription period, except as required by law or under section 12.8.
On termination:
We may update, modify, add or remove features at any time. We will try to give reasonable notice of significant changes, particularly to paid features, but we are not obliged to maintain any specific functionality.
We may update these Terms. When we do we will:
Continuing to use the Service after the effective date means you accept the updated Terms. If you do not agree, stop using the Service and cancel any paid subscription before the changes take effect.
Material change, August 2026. We corrected section 8.3. A previous version stated that extracted transcripts were returned to your browser and not stored. In fact transcripts and coaching output are retained for up to 60 days to provide conversation context and Insights, and are then deleted automatically. We also documented voice matching, the Spark cost of each action, the right of withdrawal, and governing law. No conversation data has ever been sold, shared for advertising, or used to train AI models.
These Terms and any dispute arising from them or from the Service are governed by the law of the Netherlands, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods.
The courts of Amsterdam, the Netherlands have exclusive jurisdiction, except that:
Before starting formal proceedings, please contact us at support@spark-text.com. Most problems are quicker to fix directly, and we would rather resolve it that way.
EU consumers may also use the European Commission’s Online Dispute Resolution platform. We are not obliged to participate in proceedings before a consumer arbitration board and do not currently do so.
